Human Decisions for Critical Public Services

Chapter 123 requires natural-person decisions in covered governmental emergency planning and resource allocation. It also prohibits a utility from basing a final service reduction or shutoff decision solely on AI when responding to a disaster or emergency.

Covered emergency decisions remain with natural persons.
Utility safeguards
Emergency-response service decisions cannot rest solely on AI.

Analysis · October 5, 2026

Nevada’s provision is tied to emergency management. The utility restriction should not be expanded to every ordinary service decision. Human responsibility is the common mechanism, while the government planning and utility clauses have different actors and triggers.

Coverage still under review

Verify current code and general effective-date clause, emergency implementation, utility guidance, later bills, and litigation. Selected current and concluded bills, agency rules, enforcement, and litigation have not been comprehensively screened. An omitted measure is not a finding that no relevant law exists.

Scope and method

This update expands the existing selected-law baseline using official legislative texts, codification, bill histories, and agency material. It distinguishes the act’s effective date from later duties and does not infer implementation from the passage of a deadline.

The analysis date is not a new verification date for every provision. Earlier dates remain where final text or date evidence was inaccessible. Only the separately identified in-force records enter the national export; proposed, future, and uncertain measures are excluded.
