Businesses using chatbots that try to pass as human would commit consumer fraud unless they disclose clearly that the user is talking to AI.

What it does

Amends Consumer Fraud Act to prohibit businesses from deploying chatbots or AI agents that mislead consumers into believing they are communicating with a human without clear and conspicuous disclosure.

Analyst read

HB 3021 was revived in February 2026 with unanimous Rules Committee approval, but it remained on the House calendar and was re-referred to Rules on April 17 without a floor vote. SB 317 pursued a related, narrower consumer chatbot-disclosure rule and passed the Senate, but the House re-referred it to Rules on May 31. Neither proposal became law as of the September 23 source check.
